HIPAA NOTICE OF PRIVACY PRACTICES

Your Information. Your Rights. Our Responsibilities.

This notice describes how medical information about you may be used and disclosed, how you can get access to this information, and your privacy rights. Please review it carefully.

Effective Date: September 1, 2026

Your Rights

When it comes to your health information, you have certain rights. You have the right to:

  • Get an electronic or paper copy of your medical record and other health information we maintain about you. We generally will provide a copy or summary within the time required by law and may charge a reasonable, cost-based fee when permitted.
  • Ask us to correct health information you believe is incorrect or incomplete. We may deny the request in some circumstances, but we will explain the reason in writing as required by law.
  • Request confidential communications. You may ask us to contact you in a specific way, such as at a particular phone number or address. We will accommodate reasonable requests.
  • Ask us to limit what we use or share. We are not required to agree to every requested restriction. If you pay for a health care item or service out-of-pocket in full, you may ask us not to disclose information about that item or service to your health plan for payment or health care operations, unless disclosure is required by law.
  • Get an accounting of certain disclosures. You may ask for a list of certain disclosures of your health information made during the six years before your request. We will provide one accounting in a 12-month period without charge and may charge a reasonable, cost-based fee for additional accountings within that period.
  • Get a paper copy of this Notice at any time, even if you agreed to receive it electronically.
  • Choose someone to act for you. If someone has legal authority to act as your personal representative, that person may exercise your privacy rights as permitted by law.

File a complaint if you believe your privacy rights have been violated. AlphaGenics will not retaliate against you for filing a complaint.

Your Choices

For certain health information, you may tell us your preferences about what we share. For example, you may tell us whether and how to share information with family members, close friends, or others involved in your care or payment for your care, and in certain disaster-relief situations.

If you are unable to tell us your preference, such as when you are unconscious, we may share information when we believe it is in your best interest and as permitted by law. We may also share information when necessary to lessen a serious and imminent threat to health or safety.

We will obtain your written authorization before using or disclosing your protected health information for purposes that require authorization under HIPAA, including most marketing uses, the sale of protected health information, and most uses or disclosures of psychotherapy notes. You may revoke an authorization in writing to the extent we have not already acted in reliance on it.

How We Typically Use or Share Your Health Information

Treatment. We may use your health information and share it with other health care professionals involved in your treatment. For example, we may send necessary information to a laboratory, pharmacy, specialist, or other treating provider.

Health Care Operations. We may use and disclose your health information to run our practice, manage your care, improve our services, conduct quality and compliance activities, train workforce members, and contact you when necessary.

Payment. We may use and disclose your health information to bill and obtain payment from you, a health plan, or another responsible party when applicable.

Other Uses and Disclosures Permitted or Required by Law

We may use or disclose health information without your written authorization when permitted or required by HIPAA and other applicable laws. Depending on the circumstances, this may include:

  • Public health and safety activities, including preventing disease, reporting adverse reactions, assisting with product recalls, and reporting suspected abuse, neglect, or domestic violence when authorized or required by law.
  • Health oversight activities, such as audits, investigations, inspections, and licensing activities authorized by law.
  • Research when applicable legal requirements have been satisfied.
  • Compliance with federal, Nevada, and local law, including disclosures to the U.S. Department of Health and Human Services when required to demonstrate compliance with federal privacy law.
  • Organ and tissue donation requests.
  • Coroners, medical examiners, and funeral directors when permitted by law.
  • Workers’ compensation, law-enforcement requests, and other government functions when the applicable legal requirements are met.
  • Court or administrative orders, subpoenas, lawsuits, and other legal proceedings as permitted or required by law.

Substance Use Disorder Records

To the extent AlphaGenics creates or maintains substance use disorder patient records protected by 42 CFR Part 2, additional federal confidentiality protections apply. Such records will not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against a patient unless the disclosure is permitted by applicable law, including where required consent or an appropriate court order and subpoena have been obtained.

Our Responsibilities

  • We are required by law to maintain the privacy and security of your protected health information.
  • We will notify you as required by law if a breach occurs that may have compromised the privacy or security of your information.
  • We must follow the duties and privacy practices described in the Notice currently in effect.
  • We will not use or disclose your information other than as described in this Notice unless you authorize us in writing or the law otherwise permits or requires the use or disclosure.
  • When another applicable federal or Nevada law provides greater privacy protection, we will follow the more protective requirement to the extent it applies.

Changes to This Notice

We may change the terms of this Notice, and the changes may apply to all health information we maintain, including information created or received before the change. The current Notice will be available upon request, at our office, and on our website.
